RE:            Chambers Applications before the Supreme Court

 




I have been requested to notify you about two issues before the Court.


Firstly, visiting Judges and Justice Warner note that Kentville appears to be the only location where briefs outlining the facts, issues, law and oral argument are not automatically filed with all applications. Sometimes, improperly, affidavits set out the issues and the argument. By reasons of Civil Procedure Rule 37.18, Rule 28.07 applies to chambers applications. In future, you may have chambers matters adjourned if briefs are not filed with the application.


Secondly, affidavits and supplementary materials and briefs in respect to chambers applications are often filed at the last minute, but without a cover sheet or note indicating when the application is scheduled for. As a result, these materials are filed in the normal course and may not get to the Justice before the hearing. Please attach a cover note to materials filed for chambers applications indicating the time date of the application to ensure your material gets read in time.
